1. What is Personal Information

Depending on the applicable legal definition, sensitive personal information may include categories such as health information, consumer health data, genetic data, citizenship or immigration status, racial or ethnic origin, and information relating to health benefit account programs, including flexible spending accounts (FSA) and health savings accounts (HSA), where such information is used to identify or infer health-related purchases, conditions, or activities.
When we use the term "non-personal information," we mean publicly available information, as well as information that has been aggregated or de-identified (or its equivalent term, "anonymized," under applicable data protection laws) in accordance with applicable law. Aggregated and de-identified information cannot reasonably be used to identify or be linked to a particular individual.
2. Collection and Use of Information
We collect and use personal information that is reasonably necessary for the purposes described in this notice and maintain controls designed to help limit such collection.
In the ordinary course of business and subject to applicable law, we may process personal information associated with customer service and support interactions, including relevant account and transactional information, to respond to inquiries and requests and to provide, maintain, support, secure, and improve our products and services. We may also process this information for related operational purposes, including quality assurance, personnel training, security, fraud prevention, and compliance.
We may use technologies, automated tools, and service providers acting on our behalf and subject to contractual restrictions to support these activities. We may also use aggregated or de-identified information for these purposes, where appropriate and consistent with applicable law.
We may use artificial intelligence and related technologies to support and improve our products, services, and business operations. Depending on the context, these technologies may be used to support customer service and communications, generate summaries, analyze feedback, personalize content and experiences, provide recommendations, support quality assurance and personal training, and carry out other purposes described in this notice. Where AI-powered features interact directly with you, such as virtual assistants or automated customer support tools, we provide additional disclosures where required by applicable law. Our use of these technologies is subject to this notice and applicable law.
If we use automated decision-making technology to make decisions that produce legal or similarly significant effects concerning individuals, we provide applicable notice, meaningful human involvement, and rights to the extent required by law.
We do not use automated decision-making technology (or its equivalent term “automated employment decision tools,” as defined by applicable laws) in our employee recruitment, selection, or hiring processes, except where such use is permitted by applicable law or otherwise disclosed in this notice.
Where required by applicable law, we rely on one or more of the following legal bases to collect, use, and otherwise process personal information:

We use video surveillance and related security measures in and around our retail store, clinic, and workplaces for safety, security, fraud prevention, loss prevention, and operational purposes. Personal information may be collected in connection with these activities.

Depending on the nature of your interactions with us, we may collect, use, and otherwise process personal information for the following purposes:
- Providing Products, Services, and Transactions: Processing and fulfilling orders, managing accounts, providing customer support, administering subscriptions and loyalty programs, including the LE Rewards loyalty program, verifying eligibility, fulfilling contractual obligations, processing wholesaler applications, administering contests and sweepstakes, and sending transactional communications relating to accounts, products, services, and orders.
- Laboratory Testing Services: Facilitating and supporting laboratory testing services, enabling consumers to schedule, place, manage, and receive laboratory testing services, delivering laboratory test results, and providing related customer support and compliance services.
- Health Benefit Account Program Administration: Facilitating the use of flexible spending accounts (FSA), health savings accounts (HSA), and other eligible benefit programs in connection with products and services offered by Life Extension, including verifying eligibility, processing transactions, and administering applicable benefit programs.
- Improving and Personalizing Services: Improving, maintaining, and personalizing our products, services, and content, developing and enhancing our products, services, and features, and providing recommendations and relevant content, subject to applicable law and your privacy choices.
- Quality Assurance, Service Improvement, and Personnel Training: Evaluating customer support and service quality, training personnel, maintaining operational standards, and complying with applicable law.
- Research and Innovation: Conducting research activities where lawful and with consent when required, using aggregated or de-identified information to support research, innovation, and improvement of our products and services, and conducting clinical research and related research activities in accordance with applicable law.
- Marketing, Advertising, and Audience Engagement: Communicating information about our products, services, offers, programs, and events, supporting marketing, advertising, promotional, and audience engagement activities, and providing relevant content, subject to applicable law and your privacy choices.
- Legal Compliance, Security, and Business Operations: Complying with applicable laws and legal obligations, responding to lawful requests and legal processes, protecting our rights and interests, preventing fraud and supporting security, conducting audits, oversight, and governance activities, investigating or remediating incidents, and operating, managing, and improving our business.
- Employment and Workforce Management: Administering employment, benefits, and workforce programs, supporting individuals throughout the hiring and employment lifecycle, and recruiting, evaluating, and hiring candidates.
3. Information about Children
Our online services are not directed to individuals under eighteen (18) years of age. By accessing or using our online services, you represent that you are at least eighteen (18) years of age.
We do not knowingly collect personal information directly from children, meaning individuals under thirteen (13) years of age or such other age as defined by applicable law, through our online services without authorization from a parent or legal guardian where required by applicable law. If we become aware that personal information has been collected from a child in a manner inconsistent with applicable law, we will take appropriate steps to address the situation.
In limited circumstances, we may process personal information about a child in connection with laboratory testing services, clinical research activities, or similar services authorized by a parent or legal guardian and permitted by applicable law. In those circumstances, we may collect, use, disclose, retain, and otherwise process such information for the purposes of providing the requested service, complying with legal and regulatory requirements, supporting related operational activities, and as otherwise described in this notice.
We do not knowingly sell personal information about children.
4. Sharing and Disclosure of Information
We may share or disclose personal information with the following categories of recipients for the purposes described in this notice and as permitted by applicable law:

- Health Benefit Account Program Providers: We may share personal information with service providers acting on our behalf to facilitate the use of flexible spending accounts (FSA), health savings accounts (HSA), and other eligible health benefit account programs, including to verify eligibility, process transactions, and administer health benefit account programs. Personal information shared for these purposes is limited to what is reasonably necessary to administer the applicable health benefit program.
- Loyalty Program Service Partners: We may share personal information with service providers and financial institution service partners that support loyalty programs, promotions and rewards offerings, and related program administration activities, including where you have enrolled in card-linked offer promotions administered in connection with our LE Rewards loyalty program. Such disclosures are limited to the information reasonably necessary to administer the program or promotion, verify eligibility, facilitate reward accrual and redemption, and maintain your loyalty program account.
- Marketing, Advertising, and Related Business Partners: We may share personal information with marketing, advertising, and related business partners to support marketing, advertising, audience engagement, service improvement, and other business activities, subject to applicable law and your privacy choices.
- Corporate Transactions: We may disclose personal information in connection with an actual or proposed merger, acquisition, financing, sale of assets, bankruptcy, reorganization, or similar corporate transaction.

5. Retention of Information
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this notice, including providing our products and services, supporting business operations, complying with legal and regulatory requirements, protecting our rights and interests, and resolving disputes.
Where appropriate, we may use aggregation, de-identification, or similar measures to reduce the amount of personal information retained.
We periodically review our retention practices, taking into account the purpose of the processing, the nature of the information, applicable legal requirements, and operational needs. When personal information is no longer required, we will take reasonable steps to delete, de-identify, aggregate, or otherwise manage the information in accordance with applicable law and our retention practices.
Retention periods may vary depending on the nature of the information and applicable legal, regulatory, operational, audit, investigation, dispute, or other retention requirements:
- Customers: up to six (6) years after your account is closed or your last account transaction, whichever occurs later.
- Employees and successful applicants: up to six (6) years after the end of your employment.
- Prospective customers: up to three (3) years after your last interaction with us or after you opt out of promotional or marketing communications, whichever occurs later.
- Unsuccessful applicants: up to four (4) years after we communicate our hiring decision.
- Diagnostics Laboratory Data: retained for the period required by applicable law, regulation, accreditation requirements, or other legitimate business purposes related to laboratory testing services.
- Dietary Supplement Adverse Event Data: retained as required by applicable law and regulatory requirements and for such additional periods as reasonably necessary to support product safety, compliance, investigations, audits, disputes, or other legitimate business purposes.
- Health Benefit Account Information: retained in accordance with applicable health benefit plan requirements and applicable tax, financial, legal, and operational recordkeeping obligations.
6. Protection of Information
We implement administrative, technical, and physical safeguards designed to help protect personal information from unauthorized access, use, disclosure, alteration, or destruction. Access to personal information is limited to authorized personnel and service providers with a legitimate business need to access it.
Our information security program includes measures intended to support the confidentiality, integrity, and availability of personal information and our services. We periodically evaluate and update our safeguards to address evolving risks and business needs, and we require service providers acting on our behalf to maintain appropriate security measures consistent with applicable law and contractual requirements.

We do not use sensitive personal information to train artificial intelligence models without consent where required by applicable law. We do not use automated decision-making technology to determine eligibility for, access to, or pricing of our products or services.

12. Opt-Out of Text Messaging Communications
Our Text Messaging Terms and Conditions available at www.lifeextension.com/legal/text-messaging-terms-and-conditions, govern your participation in our recurring automated text messaging and SMS short code programs, including SMS, MMS, RCS, and similar mobile messaging services, and explain how to opt out of receiving text messages. These programs may include promotional and marketing messages, such as product announcements and special offers, as well as transactional messages, such as order confirmations, shipping updates, appointment reminders, and account notifications. Links included in text messages may use standard delivery, functionality, and performance measurement technologies consistent with those described in this notice.
13. Opt-Out of the Sale, Sharing, and Targeted Advertising
While we do not sell personal information for monetary consideration, depending on the circumstances and applicable law, certain disclosures involving service providers acting on our behalf under contractual restrictions, business partners, and other third parties may be considered a "sale," "sharing," or "targeted advertising" under applicable privacy laws. Depending on your location and applicable law, you may opt out of these activities by using the “Do Not Sell or Share My Personal Information” or “Cookie Preferences” links available in our Website footer, or by using a recognized universal opt-out mechanism, such as the Global Privacy Control, through your browser or device.
We do not knowingly sell or share personal information of individuals under sixteen (16) years of age except as authorized by applicable law. For employees and job applicants, we do not sell or share personal information for targeted advertising purposes.14. Opt-Out using Universal Opt-Out Mechanisms
When your browser or device is configured to transmit your privacy preferences through a recognized “universal opt-out mechanism” (including Global Privacy Control signals), our online services will process the opt-out signal where required by applicable law. Universal opt-out mechanisms apply only to the browser or device transmitting the signal.
Please note that universal opt-out mechanisms do not automatically disable cookies used for analytics, functionality, security, or other purposes that are not subject to the opt-out request.
